Welcome to the Alta Sierra Neighborhood Alliance site (the “Site”). The Site is designed to

inform you about our collective efforts, emerging needs, meetings, and events. We aim to

provide an engaging and rewarding experience for all users, encouraging you to return often. To

help maintain a positive user experience, we ask that you adhere to the Terms and Conditions

of Use for the Site as outlined below. References to “the Organization”, “we” or “ASNA” means

the Alta Sierra Neighborhood Alliance, its committees, officers, service providers,

representatives and designees.

Agreement

By accessing and/or entering the Site, you agree to comply with the Terms and Conditions of

Use, Privacy Policy, and other applicable policies (collectively the “Terms of Use”). The Terms of

Use also apply to your use of our official social media channels, including Facebook, Twitter and

Instagram (“Social Media Sites”), as applicable. If you do not agree to the Terms of Use, do not

access the Site or Social Media Sites. Alta Sierra Neighborhood Alliance reserves the right to

update the Terms of Use at any time without prior notice. Any amendments become effective

Immediately.

Eligibility, Registration and Passwords

To register and use the Site you must:

(a) be 18 years of age or older.

(b) be a member in good standing with the Organization.

(c) provide and maintain accurate, correct and complete information as requested during

registration ("Registration Data").

If the information you have provided in your Registration Data is not accurate or is incomplete,

we may suspend or terminate your ability to use the Site. You are responsible for any changes

or updates to your Registration Data. Your Registration Data is subject to our Privacy Policy.

Access to the Site requires a username (your registered email) and a password. You are

responsible for keeping your password confidential and must notify us immediately at

neighbors@asnagv.com if you suspect unauthorized access to your account. You are fully

responsible for all activity that occurs under your account.

Restrictions

The Site and all content are owned by the Alta Sierra Neighborhood Alliance. You are granted

non-transferable, non-exclusive access to the Site to view information and interact for your own

personal use. Commercial use of the Site is prohibited. All content, including but not limited to

trademarks, designs, logos, text, images, audio, and video materials are the intellectual property

of the Organization or our affiliates (“Organization Intellectual Property” or “Organization IP”)

and is protected by copyright and trademark law. You may not use, distribute or alter any

Organization Intellectual Property without explicit written consent from ASNA.

Information Submitted Through the Site

Your use of and submission of information through the Site is governed by ASNA’s Privacy

Policy and Terms of Use. You affirm that the information you provide is true and accurate and

will be kept up to date. ASNA reserves the right to refuse usernames or email addresses that

are already in use; that could be construed as impersonating another person, that infringe on

any intellectual property rights or are offensive. You are wholly responsible for any transactions

and interactions that occur in connection with your username, and you agree to notify the

Organization immediately in the case of any security breach related to your account.

Communications

By providing your Registration Data, you are providing your express written consent to receive

communications from the Organization (including its affiliates, agents, and service providers) for

any purpose related to our collective efforts, emerging needs, meetings, and events. You agree

that you consent to these communications regardless of whether your phone number or email address are on any state or federal “Do Not Call” or “Do Not Email” list.

Rules of Conduct

By using the Site, you agree to comply with applicable laws, regulations and rules, and to

respect other users. Use of the Site is your agreement to comply with the following rules of

conduct. Violation of these rules may result in termination of access to the Site. We may update

these rules at our discretion, with changes taking effect upon posting. We encourage you to

frequently review the Terms of Use for any changes.

You agree not to:

o Post or transmit harmful, threatening, harassing, hateful, defamatory, obscene, or

unlawful content.

o Upload viruses, spyware, or other harmful programs intended to disrupt the

operation of the Organization.

o Distribute unsolicited or unauthorized advertisements.

o Share personally identifiable or confidential information without consent.

o Violate others' rights or privacy or engage in fraudulent activity.

o Impersonate others, falsely represent your affiliation with ASNA or imply ASNA

endorsement for any statement you make.

o Interfere with Site operations or restrict access for others.

o Use the Site for commercial purposes, including reproduction, selling, or

modifying content.

o Download or store any Site content.

o Collect or mine data from the Site without permission.

You are solely responsible for all computer equipment and services needed to access the Site.

Alta Sierra Neighborhood Alliance reserves the right to remove any content that violates these

rules, the Terms of Use, or infringes upon third-party rights.

Requested Content

From time-to-time, the Alta Sierra Neighborhood Alliance may ask users to upload content for

display on the Site. By submitting content (each a “Submission”), you grant ASNA the right to

use, display, modify, or reproduce the Submission, without compensation or restriction, for

purposes including promoting the Site and the Organization. This right applies to all current and

future formats and channels. You also affirm that you have the necessary rights to grant these

licenses and that your Submission complies with all applicable laws, rules, and regulations.

ASNA does not claim ownership rights on any Submission. You retain any rights you have to

your Submission, subject to the license granted to ASNA for its use. This section remains in

effect even after the termination of the Terms of Use.

ASNA may, in its sole discretion, alter, revise, or refuse to post Submissions to the Site. If you

feel any content or Submission is unlawful, offensive, or objectionable please email

neighbors@asnagv.com

Termination

You agree that ASNA may terminate your access to, or use of the Site at any time and for any

reason, without notice or liability. Upon termination, your right to use the Site will cease

immediately. ASNA may deactivate or delete your username or password and any associated

information, restricting further access. ASNA is not liable to you or any third party for access

termination or the deletion of your information or files and is not required to provide you with

future access to such information.

Enforcement of Compliance

ASNA reserves the right to enforce compliance with the Terms of Use, including but not limited

to, any legal process related to your use of the Site or claims by third parties that your use of the

Site is unlawful or violates their rights.

Links To or From Other Websites

The Site may provide links to third-party websites and resources that are not under the control

of nor maintained by ASNA. Unless specifically stated, ASNA is not affiliated with any third-party

websites that link to or are linked from the Site. ASNA disclaims any responsibility for the

accuracy, content, or availability of information found on such websites. ASNA makes no

guarantees regarding your satisfaction with products or services that are available through such

third-party websites, nor do we make warranties as to the security of any information that you

may provide to any third party, whether through those websites or otherwise.

You agree that your use of third-party websites and resources is at your own risk, and that the

terms and conditions of those websites apply to your use. ASNA reserves the right to block links

to third-party websites without prior notice and at its sole discretion. Additionally, we are not responsible for any technical issues or other problems associated with any linked third-party websites.

Disclaimers

The Site is provided “as is.” All materials and information on the Site are provided without any

warranty, express or implied, regarding the accuracy or reliability of the content, including

content provided by ASNA or any third party. ASNA is not responsible for third-party

advertisements, goods, or services posted on or through the Site. We are not liable for the

conduct of any user, whether online or offline, including any content submitted by users.

We assume no responsibility for errors, omissions, interruptions, deletions or delays in operation

or transmission, theft or destruction, or unauthorized access or alteration of user

communications. We are also not responsible for technical problems, including issues with

networks, online systems, service providers, computer equipment, software, email failures, or

traffic congestion. Under no circumstances shall ASNA be liable for any loss, damage, or

personal injury resulting from the use of the Site, attendance at an event, content posted by

other users, or user conduct, whether online or offline.

Limitations of Liability

In no event shall ASNA, its affiliates, officers, agents, partners, employees or service providers

be liable to you or any third party for any damages, including but not limited to, any indirect,

consequential, exemplary, incidental, special or punitive damages, such as loss of profits, loss

of data, irrespective of whether or not the Organization has been advised of the possibility of

such damages. This applies to any theory of liability arising out of or in connection with your use

of the Site or links to other websites from the Site.

Your sole and exclusive remedy for dissatisfaction with the Site is to stop using it. If any

warranty exclusion or limitation of liability in this agreement is held unenforceable or

inapplicable, the total aggregate liability of ASNA for all damages, losses, or causes of action

will be limited to the amount, if any, paid by you to ASNA to access and use the Site.

Indemnification

You agree to defend, indemnify and hold us, our affiliates, officers, agents, partners, employees,

members and service providers harmless from any loss, liability, cost, expense, claim, or

demand, including without limitation, reasonable attorneys’ fees arising out of or relating to your

use of the Site in violation of the Terms of Use. Additionally, you agree to indemnify, defend, and

hold ASNA harmless from any and all claims, actions, demands, causes of action, and other

proceedings arising from or related to your use of the Site, or any third-party websites linked

thereto.

Governing Law

The Terms of Use will be governed by the laws of California, without regard to principles of

conflict of law. Any dispute relating to the Terms of Use or the Site may be litigated only in

Nevada County for state court causes of action and in Sacramento, California for federal court

causes of action. You agree that any claim or cause of action arising out of or related to use of

the Site must be filed within one (1) year after it arises.

ASNA's failure to enforce any right or provision of the Terms of Use does not waive such rights

or provisions. The Terms of Use may be enforced to the fullest extent allowed by law. If any

provision is found to be unlawful, void, or unenforceable, that provision will be negated, and the

remaining provisions will remain in full force.

Miscellaneous

The Terms of Use do not create any partnership, joint venture, or employer-employee

relationship between you and ASNA. You may not assign or transfer any or all of your rights or

obligations under the Terms of Use without prior written consent of ASNA. Headings or section

titles are for the purpose of convenience and do not define or explain the subsequent sections.
